Below are some facts you need to know when buying or selling a home.Listing Services in the Atlanta Area: There are two listing service companies, Metro Listing Service and First Multiple Listing Service. The Atlanta Realty Depot uses both of these services to locate your new home and to List your home for sale. Most Real Estate companies use one or the other, not many companies will subscribe to both. By using both services, we cover the Atlanta area for your benefit. Real Estate agents will commonly go to the listing services to find properties that are for sale. We provide all the information to these services including pictures of your home. The Metro Listing Service puts all their listings on the Internet at www.cyberhomes.com and the First Multiple Listing Service puts all their listings on the Internet at www.realtor.com . You also will have your home listed on our web site in addition to these two. This gives you coverage both locally and nationally. Sellers Property Disclosure Form: The seller of a home must declare all know defects in the dwelling. To aid the seller in this declaration, a Sellers Property Disclosure Form should be used. This form lists all possible category anomalies with a dwelling. It is a simple matter of checking the items in the form. Buyers should look for this form when viewing a home. This form is required to be filled out by the seller and must include all defects known now or in the past. The important thing to remember is all defects must be declared. Termite Inspection: A seller will be required to provide a letter from a reputable pest control company stating that the dwelling is free from termite infestation. Most home owners have an annual contract with a pest control company for this service. An update from this company will be required before you can close on the sale of the home. If you do not have an existing company, obtain one to do an inspection before you put your home up for sale. Home Appraisal: The mortgage company for the buyer will send an appraiser to the sellers home before the loan can be closed. The seller should provide easy access to the appraiser to all areas of the home. Home Inspection: More and more frequently, buyers are having private home inspectors pre-inspect the home they intend to purchase. The real estate contract will probably have a clause that states that the contract can be void if the home inspectors findings are not corrected by the seller in a reasonable length of time. This service seems to becoming normal with new home and resale home purchases. Agency RelationshipsEach Real Estate Sales Person and / or Broker must declare to you the type of Agency Relationship you have with the Agent or Broker. There are several types of Agency and you should know what each one represents. Sellers Agent: A sellers agent represents the SELLER in the Real Estate transaction. The sellers agent has a loyalty to perform to the best of their abilities to perform according to the wishes of the Seller. A buyer being shown a Sellers agent's property will probably be treated a Customer and not a Client. As a customer, the buyer will not be represented by the Sellers agent in the transaction. Some companies may elect to treat the Buyer as a client for the Sellers Agents property. In this case a Dual Agency occurs. The Sales Person is representing both the Seller and the Buyer. This can be perilous act. The Sales Person will have difficulty in providing proper service and loyalty to both the Buyer and Seller. Buyers Agent: A buyers agent represents the Buyer in the Real Estate transaction. The Buyers agent has a loyalty to perform to the best of their abilities to perform according to the wishes of the Buyer. Most transactions occur with both a Buyers agent and another agent as a Sellers agent. This usually does not cause a relationship problem, unless the Buyers agent and Sellers agent work for the same Real Estate Company. Transaction Agent: A transaction agent does not represent either the Buyer or Seller, but merely oversees the bringing together of two parties interested in performing a Real Estate transaction. There is no conflict since the Transaction Agent has nothing to do with either the Buyer or Seller but merely oversees the coming together of the two parties. If you select a Flat Fee selling service with a Real Estate company, you are probably entering into a Transaction Agency agreement with the Agent.
